Call to Action: Masks
The LCPS mask mandate is based on the VDOH Order dated August 12, 2021. A documented exception to wearing a mask is detailed in item (D) “Any person who has trouble breathing”. The order also states that if you qualify for an exception, you may request a reasonable accommodation.
The enforcing authority for the order is the VA D.O.H per Code of VA 32.1-27. LCPS does NOT have authority to enforce the mandate
A mask is a medical device as defined by the Food, Drug, and Cosmetic Act 201(h) that affects the human bodily function of breathing. LCPS does not have legal authority to mandate the use of a medical device.
Furthermore, under the Code of VA 18.2-422 it is unlawful to wear a mask in public for persons 16 or older without specific exceptions. The mask mandate is forcing citizens to conceal their identities in public without a Bonafide medical reason from the person forced to wear it. There is no provision to waive this law as in a previous executive order from the governor that has since been rescinded.
